Acknowledgment of Risk
I understand that participating in or being near a mobile golf simulator involves inherent and foreseeable risks. These risks include, but are not limited to, being struck by a golf club or golf ball; injuries caused by swinging clubs; slips, trips, or falls; contact with simulator equipment, turf, cords, stakes, screens, frames, or other objects; equipment malfunction; uneven ground; weather conditions; and the actions of other participants or guests. Injuries may include property damage, minor or serious bodily injury, permanent disability, or death.
I voluntarily choose to participate and knowingly accept and assume all risks associated with the golf simulator activity, whether those risks are known or unknown, anticipated or unanticipated.
Host and Guest Responsibilities
As the event host, I am responsible for informing my guests of these waiver terms and all safety requirements established by Sac Mobile Golf. I will make reasonable efforts to ensure that my guests use the simulator and equipment safely and follow all instructions provided by Sac Mobile Golf staff.
Only one participant may enter the designated hitting area and swing a golf club at a time. All other guests must remain a safe distance behind the participant. Participants must check that the hitting area is clear before every swing. Golf clubs may only be swung inside the designated hitting area and must never be thrown, used as toys, or swung near another person.
Children and minors must be supervised by a responsible adult at all times. The event host is responsible for helping ensure that minors do not enter the hitting area without permission or proper supervision.
Guests who are impaired by alcohol, cannabis, medication, drugs, or any other substance must not participate if their condition makes participation unsafe. The event host agrees to help prevent visibly impaired or unsafe guests from using the simulator.
Unsafe or Reckless Conduct
Reckless behavior, horseplay, fighting, intentional misuse of equipment, ignoring safety instructions, striking objects other than the golf ball, swinging outside the designated hitting area, and intentionally damaging Sac Mobile Golf equipment are strictly prohibited.
Sac Mobile Golf may immediately pause or end participation by any guest who behaves recklessly, appears unable to participate safely, refuses to follow instructions, or creates a risk to people or property.
Sac Mobile Golf reserves the right to immediately stop or end the entire event without a refund if unsafe or reckless behavior continues, if the event host or guests refuse to follow instructions, or if the equipment is intentionally misused or damaged.
Equipment and Property Damage
The event host accepts financial responsibility for damage to or loss of Sac Mobile Golf equipment caused by the intentional, reckless, negligent, or improper conduct of the host or their guests. This includes, but is not limited to, damage to the golf simulator, launch monitor, projector, computer, screen, enclosure, turf, clubs, cords, accessories, or any other equipment supplied by Sac Mobile Golf.
Normal wear and tear, ordinary equipment failure, and damage not caused by the host or guests will not be charged to the event host. Sac Mobile Golf will provide documentation of any damage and the reasonable cost of repair or replacement when requesting reimbursement.
Release and Waiver of Liability
To the fullest extent permitted by California law, I release, waive, and hold harmless Sac Mobile Golf and its owners, employees, contractors, agents, and representatives from claims, demands, damages, losses, or causes of action arising from my participation in or presence near the golf simulator activity, including claims involving personal injury, death, or property damage.
This release is intended to include claims arising from the ordinary negligence of Sac Mobile Golf to the fullest extent permitted by law. It does not release conduct or liability that cannot legally be waived under California law.
I understand that Sac Mobile Golf does not guarantee that the activity or event area will be entirely free from risk. I accept personal responsibility for deciding whether I am physically capable of safely participating.
Medical Treatment
If an injury or medical emergency occurs, I authorize Sac Mobile Golf staff to contact emergency medical services when they reasonably believe assistance is necessary. I understand that Sac Mobile Golf staff are not required to provide medical treatment and are not responsible for the cost of emergency transportation, medical care, or treatment.
Indemnification
To the fullest extent permitted by law, I agree to indemnify and hold harmless Sac Mobile Golf and its owners, employees, contractors, agents, and representatives from third-party claims, damages, or expenses arising from my own conduct or the intentional, reckless, negligent, or improper conduct of my guests.
Weather and Event Conditions
Outdoor participation may involve additional risks caused by rain, wind, heat, cold, wet surfaces, uneven ground, or other weather and site conditions. Sac Mobile Golf may pause or discontinue operation when weather, ground conditions, electrical conditions, or other circumstances make continued operation unsafe.
Guests may not move, disconnect, adjust, climb on, or tamper with the simulator, enclosure, projector, launch monitor, electrical cords, stakes, weights, computer, or any other Sac Mobile Golf equipment unless instructed to do so by Sac Mobile Golf staff.
Electronic Signature and Agreement
I confirm that I am at least 18 years old and have the legal capacity to enter into this agreement. If I am signing as the parent or legal guardian of a participating minor, I confirm that I have the legal authority to do so.
I understand that typing my full legal name, drawing my signature, checking the agreement box, and electronically submitting this waiver constitute my electronic signature. I agree that my electronic signature has the same force and effect as a handwritten signature.
I confirm that I have had the opportunity to read this entire agreement, understand its terms, and ask questions before signing. I understand that I am giving up certain legal rights by signing this agreement. I am signing voluntarily and without pressure.
If any portion of this agreement is found to be invalid or unenforceable, the remaining portions will continue in effect to the fullest extent permitted by law. This agreement will be governed by the laws of the State of California.
